There is an old saying - sometimes
it's better to act and ask forgiveness than to wait for
permission. Are you waiting for some CYA bureaucracy to give you
permission?
We have a client in a regulated
industry that was retooling their business into an innovate, lean company
that could be a leader in the new deregulated world. Their state had passed a new
deregulation law giving the client the perfect opportunity to define the
meaning of the law through bold action. The defenders of the status quo brought suit
to challenge our client's restructuring. Instead of waiting, as the lawyers chewed
away, earning a living without much concern for the merits of the
argument, our client moved ahead to implement what the legislature
clearly intended.
By
acting in their best interests, our client achieved success in spite of bureaucratic
road-blocks. At the end of the day the final
result of the lawsuit would be moot for as one lawyer so succinctly
said "The egg has been scrambled and there's no putting it back
together now."
